Federal Programs Branch represents the federal government in civil litigation in district courts throughout the United States, defending actions attacking the legality of high-profile government policies and decisions. As part of its practice, the Branch handles cases at the cutting edge of administrative law and constitutional law, including the scope of the powers of Congress, the President, and the Federal Courts. The Branch also brings affirmative litigation to enjoin actions of state and local governments that conflict with the Supremacy Clause of the U.S. Constitution and to enforce a variety of agency statutory and regulatory powers. Branch litigation frequently requires coordination with involved agencies, the White House, and the Department of Justice’s leadership offices.

Represent federal agencies and officials in all phases of civil litigation involving statutory and constitutional claims, including pre-trial motions, discovery, mediation, trial advocacy, and appellate practice. Litigate in the U.S. District Court for the District of Columbia and the U.S. Court of Appeals for the D.C. Circuit. Client agencies include HHS, FBI, DHS, CIA, NSA, FCC, DOJ, OSC, OMB, EPA, ATF, SBA, Department of State, Export-Import Bank, among others.

Successfully defended federal agencies in jury trials in federal district court. For example, defended the FBI at trial in Youssef v. Lynch, No. 11-1362 (D.D.C.), against retaliation claim brought by former management official in the Bureau's Counterterrorism Division. Obtained jury verdict in favor of Defendant.
