Terms of Service

Welcome to Flows CV. These Terms of Service ("Terms") govern your access to and use of the Flows CV website at flows.cv and all related services, features, and applications (collectively, the "Service") operated by Flows CV ("Flows," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. Please read these Terms carefully before using the Service.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.

2. Eligibility

To use the Service, you must:

  • Be at least 16 years of age
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable laws
  • Provide accurate and complete registration information

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Account Registration and Security

3.1 Account Creation

To access certain features of the Service, you must create an account. During our beta period, account creation is by invitation only via our waitlist. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

3.2 Username Selection

Your username will form part of your public portfolio URL (flows.cv/username). You may not select a username that: impersonates another person or entity, is offensive or inappropriate, infringes on any trademark or intellectual property rights, or is intentionally confusing or misleading. We reserve the right to reclaim or reassign usernames at our discretion.

4. User Content

4.1 Your Content

"User Content" means any content you create, upload, submit, or display through the Service, including but not limited to: portfolio projects, work experience, education history, blog posts, profile information, images, videos, resumes, and any other materials.

4.2 Ownership

You retain all ownership rights to your User Content. By submitting User Content to the Service, you grant Flows a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, display, and distribute your User Content solely for the purpose of operating and providing the Service. This license includes the right to create AI-generated summaries, structured data representations, and semantic markup of your content to improve discoverability. This license terminates when you delete your content or your account.

4.3 Content Responsibility

You are solely responsible for your User Content and represent and warrant that:

  • You own or have the necessary rights to use and authorize us to use your User Content
  • Your User Content does not infringe upon the intellectual property rights of any third party
  • Your User Content is accurate and not misleading
  • Your User Content complies with all applicable laws and these Terms

4.4 Content Removal

We reserve the right, but have no obligation, to monitor, review, or remove User Content at our sole discretion. We may remove or disable access to any User Content that we determine violates these Terms, is objectionable, or may expose Flows to liability.

5. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

  • Violating any applicable laws, regulations, or third-party rights
  • Using the Service for any illegal or unauthorized purpose
  • Posting false, inaccurate, misleading, or fraudulent content
  • Impersonating any person or entity, or falsely stating or misrepresenting your affiliation
  • Uploading content that is defamatory, obscene, abusive, or hateful
  • Uploading content that contains viruses, malware, or other harmful code
  • Attempting to gain unauthorized access to the Service, other accounts, or computer systems
  • Interfering with or disrupting the Service or servers or networks connected to the Service
  • Using automated means (bots, scrapers, spiders) to access or collect data from the Service without our express permission
  • Circumventing or attempting to circumvent any security features of the Service
  • Harvesting or collecting email addresses or other contact information of users
  • Using the Service to send spam, unsolicited messages, or promotional materials
  • Engaging in any activity that could damage, disable, overburden, or impair the Service
  • Selling, reselling, or commercially exploiting the Service without authorization
  • Using the Service in any manner that could interfere with other users' enjoyment of the Service

6. AI Features and Limitations

6.1 AI-Powered Features

The Service includes various AI-powered features, including but not limited to:

  • AI chat assistant for visitors viewing your portfolio
  • AI-powered content suggestions and writing assistance
  • Job matching and fit analysis
  • Resume parsing and enhancement
  • Content summarization and formatting
  • AI-generated professional summaries and structured data for profile discoverability

6.2 Profile Discoverability

By creating a profile on the Service, you consent to your public professional data being structured for indexing and discovery by search engines, LLM providers, and AI-powered recruitment tools. We use structured data markup, semantic tagging, and AI-generated summaries to make your profile queryable by these systems. This consent covers your public profile data only — private data as defined in our Privacy Policy is never exposed. You may withdraw consent at any time by deleting your account.

6.3 AI Limitations and Disclaimers

You understand and acknowledge that:

  • AI-generated content may contain errors, inaccuracies, or inappropriate material
  • AI features are provided "as is" and may not always produce desired results
  • You are responsible for reviewing and editing any AI-generated content before publishing
  • AI job matching is based on algorithms and may not perfectly reflect actual job fit
  • The AI chat represents your portfolio content but may occasionally provide inaccurate responses
  • We do not guarantee the accuracy, reliability, or appropriateness of any AI-generated content

6.4 AI Data Usage

Your portfolio content is processed by AI systems to provide the features described above. This processing is governed by our Privacy Policy. We use Microsoft Azure OpenAI and AWS Bedrock services, and your content is not used to train AI models.

7. Data Protection and Automated Access

7.1 Unauthorized Automated Access

You may not, and you may not permit any third party to, engage in any of the following without our express prior written consent:

  • Scraping, crawling, spidering, or using any automated means to access, index, or collect data from the Service, except as expressly authorized in Section 7.2
  • Bulk downloading, copying, or extracting profile data, user content, or any portion of our database
  • Systematic or programmatic extraction of data from the Service, whether through APIs, bots, scripts, browser extensions, or any other automated mechanism
  • Mirroring, framing, or reproducing any substantial portion of the Service or its content
  • Building or contributing to any database, dataset, directory, or repository using data obtained from the Service
  • Using data obtained from the Service to train, fine-tune, or evaluate machine learning models without explicit written authorization
  • Reselling, sublicensing, or redistributing data obtained from the Service to any third party

7.2 Authorized Automated Access

The following categories of automated access are authorized, provided they comply with our published directives:

  • Search engine crawlers that comply with our robots.txt directives
  • LLM providers and AI systems that comply with our robots.txt and llms.txt directives
  • Any automated system that has received explicit written authorization from Flows

Our robots.txt and llms.txt files, located at the root of our domain, are the authoritative sources for which automated systems are permitted. These files may be updated at any time. Compliance with these directives is a condition of authorized access.

The following types of automated access are never authorized absent explicit written agreement: scraping tools and services, data brokers and enrichment services, competing job platforms or talent marketplaces, headcount or compensation data aggregators, and any system that repackages or resells profile data. If you are unsure whether your use case qualifies, contact legal@flows.cv before proceeding.

7.3 Legal Consequences of Unauthorized Access

Unauthorized access to, scraping of, or data extraction from the Service constitutes:

  • A material breach of these Terms of Service
  • A potential violation of the Computer Fraud and Abuse Act (18 U.S.C. § 1030), which prohibits unauthorized access to protected computer systems
  • A potential violation of the California Comprehensive Computer Data Access and Fraud Act (Cal. Penal Code § 502) and equivalent state computer fraud and unauthorized access statutes in all applicable jurisdictions
  • A potential violation of applicable state consumer protection and unfair business practices statutes

Access to the Service is conditioned on compliance with these Terms. Any access that exceeds or violates the scope of authorization defined herein and in our published access policies is unauthorized access within the meaning of applicable federal and state law.

7.4 Liquidated Damages

You acknowledge that unauthorized scraping, extraction, or collection of profile data from the Service causes harm to Flows and its users that is difficult to quantify. The parties agree that the following liquidated damages are a reasonable pre-estimate of the harm caused and are not a penalty:

Any person or entity that accesses, scrapes, extracts, copies, or collects profile data from the Service in violation of this Section 7 shall be liable for liquidated damages of $500 (five hundred United States dollars) per profile accessed, extracted, or collected, plus all costs, expenses, and reasonable attorneys' fees incurred by Flows in identifying, investigating, and enforcing against the unauthorized access.

This liquidated damages provision is cumulative and does not limit Flows' right to seek injunctive relief, actual damages (where they exceed liquidated damages), statutory damages under applicable federal or state law, or any other remedy available at law or in equity.

7.5 Proprietary Data Signatures

The Service incorporates proprietary technical measures and data signatures designed to identify the source and integrity of data originating from our platform. Any reproduction, display, or distribution of data containing these identifiable signatures outside the Service or in violation of these Terms constitutes evidence of unauthorized access and a breach of these Terms. Flows reserves the right to use such evidence in any legal proceeding.

7.6 Synthetic and Test Data

The Service may contain synthetic, test, or fictitious profiles created by Flows for quality assurance, data integrity monitoring, security testing, and enforcement purposes. These profiles are the proprietary property of Flows.

Any reproduction, extraction, storage, or distribution of synthetic or test data from the Service by any third party constitutes prima facie evidence of unauthorized access to and extraction of data from the Service in violation of this Section 7. The presence of Flows' synthetic data in any third-party database, dataset, product, or service creates a rebuttable presumption that such third party engaged in unauthorized scraping or extraction. Flows is not obligated to identify, label, or distinguish synthetic profiles from authentic user profiles.

7.7 Available Remedies

In addition to liquidated damages, Flows reserves the right to pursue any or all of the following against any person or entity that violates this Section 7:

  • Immediate termination of access to the Service without notice
  • Temporary and permanent injunctive relief
  • Actual, consequential, and incidental damages
  • Statutory damages under the CFAA, state computer fraud statutes, and other applicable law
  • Recovery of all reasonable attorneys' fees, expert witness fees, court costs, and litigation expenses
  • Any other relief a court of competent jurisdiction deems just and equitable

8. Tracking Links and Session Recordings

8.1 Tracking Features

The Service allows you to create tracking links to monitor how visitors interact with your portfolio. These features include:

  • View counts and unique visitor tracking
  • Session duration and project viewing analytics
  • Visitor location, device, and browser information
  • Session recordings that capture visitor interactions with your portfolio

8.2 Your Responsibilities

When using tracking features, you agree to:

  • Use tracking data ethically and in compliance with applicable privacy laws
  • Not use tracking features to harass, stalk, or harm any individual
  • Respect the privacy of portfolio visitors
  • Consider disclosing tracking practices to visitors where required by law

9. Third-Party Services and Links

The Service may contain links to third-party websites, services, or resources that are not owned or controlled by Flows. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that Flows shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

10. Intellectual Property Rights

10.1 Flows' Intellectual Property

The Service and its original content (excluding User Content), features, functionality, software, design, data structures, data signatures, and synthetic data are and will remain the exclusive property of Flows and its licensors. The Service is protected by copyright, trademark, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

10.2 Database Rights

The compilation, organization, and arrangement of data within the Service constitutes a protectable database under applicable law. Unauthorized extraction or reutilization of a substantial portion of the contents of our database is prohibited.

10.3 Feedback

If you provide any feedback, suggestions, or ideas about the Service, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use and incorporate such feedback into the Service without any obligation to you.

11. Job Discovery and Curated Roles

The Service may provide job discovery features including curated job shortlists. You understand that:

  • Job listings are provided for informational purposes only
  • We do not guarantee the accuracy, completeness, or availability of any job posting
  • We are not responsible for any employment decisions made based on information provided through the Service
  • Job matches and fit scores are estimates and should not be the sole basis for application decisions
  • We do not guarantee that you will receive job offers or interviews
  • Interactions with potential employers are between you and the employer; we are not a party to any employment agreement

12. Password-Protected Content

You may password-protect individual projects in your portfolio. When using this feature:

  • You are responsible for managing access to password-protected content
  • We are not responsible for unauthorized access if you share passwords
  • Access requests are processed through our notification system, and you control approval/rejection
  • Password protection is provided as-is and should not be relied upon for highly sensitive information

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting us at support@flows.cv. Upon termination, your right to use the Service will immediately cease.

13.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Conduct harmful to other users, third parties, or the Service
  • Extended periods of inactivity

13.3 Effect of Termination

Upon termination, your right to use the Service will cease immediately. We may delete your User Content, though some information may be retained as required by law or for legitimate business purposes. All provisions of these Terms that should reasonably survive termination shall survive, including without limitation Sections 7, 10, 14, 15, 16, and 18.

14. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

FLOWS DOES NOT WARRANT THAT:

  • THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
  • THE RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE OR RELIABLE
  • ANY ERRORS IN THE SERVICE WILL BE CORRECTED
  • THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS
  • AI-GENERATED CONTENT WILL BE ACCURATE, APPROPRIATE, OR FREE FROM ERRORS
  • YOUR PROFILE WILL APPEAR IN ANY PARTICULAR SEARCH ENGINE, AI SYSTEM, OR DISCOVERY TOOL
  • THIRD-PARTY SYSTEMS WILL HONOR DEINDEXING REQUESTS WITHIN ANY SPECIFIC TIMEFRAME

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FLOWS, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL
  • SERVICE INTERRUPTION OR COMPUTER DAMAGE
  • COST OF SUBSTITUTE SERVICES
  • ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT
  • EMPLOYMENT DECISIONS BASED ON INFORMATION FROM THE SERVICE

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO FLOWS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER. THIS LIMITATION DOES NOT APPLY TO LIABILITY ARISING FROM VIOLATIONS OF SECTION 7 OF THESE TERMS.

16. Indemnification

You agree to defend, indemnify, and hold harmless Flows, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your User Content; (c) your use of the Service; (d) your violation of any rights of another; or (e) your violation of any applicable laws.

Without limiting the foregoing, any person or entity that accesses, scrapes, extracts, copies, collects, or otherwise obtains data from the Service in violation of Section 7 agrees to indemnify, defend, and hold harmless Flows and its users from and against all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and expert witness fees) arising from such unauthorized access, including costs of investigation, damages to users whose data was improperly accessed, reputational harm, and any regulatory fines or penalties imposed on Flows as a result.

17. Fair Credit Reporting Act Disclaimer

Flows CV is not a consumer reporting agency as defined by the Fair Credit Reporting Act ("FCRA"), 15 U.S.C. § 1681 et seq. The Service does not constitute a "consumer report" as defined by the FCRA. You may not use the Service or any information obtained through the Service as a factor in determining any individual's eligibility for credit, insurance, employment, or any other purpose regulated by the FCRA or similar state laws. If you use the Service for employment screening purposes, you do so at your own risk and must independently comply with all applicable requirements of the FCRA and equivalent state laws.

18. Governing Law and Dispute Resolution

18.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

18.2 Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall first be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules.

18.3 Injunctive Relief

Notwithstanding Section 18.2, Flows may seek temporary or permanent injunctive relief in any court of competent jurisdiction to prevent unauthorized access, scraping, or data extraction in violation of Section 7, without the requirement of posting a bond or proving actual damages. You agree that a breach of Section 7 would cause irreparable harm for which monetary damages alone would be an inadequate remedy.

18.4 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in class actions or class-wide arbitration.

19. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its intent. If such modification is not possible, the provision shall be severed, and the remaining provisions shall continue in full force and effect. In particular, if the liquidated damages provision in Section 7.4 is found to be unenforceable, Flows shall be entitled to recover its actual damages resulting from the breach.

20. Waiver

The failure of Flows to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Flows.

21. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or policies published by us on the Service, constitute the entire agreement between you and Flows regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.

22. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service prior to the change becoming effective. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the Service.
